Little v. Hecox and B.P.J. v. West Virginia ask whether Title IX and the Constitution permit schools to separate sports and facilities by biological sex. Our amicus brief, joined by more than 50 Pennsylvania school board members, explains that sex-based distinctions are not only lawful but necessary to preserve fairness in women’s athletics and to protect student privacy. Title IX’s purpose—to expand opportunities for girls—is undermined when biological males are allowed in female divisions or private spaces. We urge the Court to affirm that schools have both the authority and the duty to uphold these protections.
