Lawsuit – PA School District tells student to ‘tolerate’ undressing with student of the opposite sex; to make it as ‘natural’ as possible.

SUMMARY: The Boyertown Area School District, without parent or student notification, made an unwritten change to school policy and opened its sex-specific restrooms and locker rooms to students of the opposite sex. When a student was standing in his underwear about to put his gym clothes on, he suddenly realized there was a member of the opposite sex changing with him in the locker room, who was also in a state of undress.

He brought a complaint to school officials, who informed him that they now let students of one sex who mentally identify themselves with the opposite sex choose whichever locker room they want to use.  He asked for his privacy to be protected somehow but was instead told twice that he must “tolerate” it and make changing with students of the opposite sex as “natural” as he possibly could.

With the help of the Independence Law Center, a lawsuit has now been filed against the school district for the sexual harassment and for violation of the fundamental right to bodily privacy from persons of the opposite sex. The lawsuit  is asking for a change in policy. The school district was given the opportunity to reverse its policy, but its Board has since voted 6-3 to continue to open bathrooms and locker rooms to persons of the opposite biological sex.
